Moosic Zoning Board of Adjustments will hold a Public Hearing on Wednesday, February 12, 2025 at 7PM in the Moosic Municipal Building at 715 Main Street, Moosic, PA.
Richard Para, Death Valley Realty, R 4113 Birney Avenue, Moosic, are requesting a special exception to open a Drug Counseling Center.
Interested parties are invited to attend and provide testimony.
Summary: “The property owner intends on operating Ridge Valley Recovery (RVR), located at 4113 Birney Avenue, Suite B, Moosic PA 18507. The location, which is zoned C-2 will be used solely as an Outpatient Counseling Center and offer services identical to those of John G. Kuna and Associates located next door at 4101 Birney Ave, Moosic. All counseling will occur during regular daytime and night business hours and will not include the overnight stay of patrons. Additionally, the center will not prescribe, distribute or provide medication to patients. It is the position of the applicant that the activity that will occur at this office does not meet the definition of drug rehabilitation facilities or drug treatment centers found in Section 300-23G and Section 300-58 of the Moosic Borough Zoning Ordinance. Being advised by the Borough Zoning Officer that a special use exception is needed, the applicant respectfully requests a hearing seeking the grant of a special exception to permit its outpatient counseling center. Section 300-23G – Drug Rehabilitation Facilities and Drug Treatment Centers
3. No methadone treatment facility or any other permitted drug rehabilitation facilities and drug treatment centers shall be nearer to any of the following uses than 500 feet. For the purposes of this section, spacing distances shall be measured as follows 1) from all property lines of the uses regulated in this Subsection G hereof; 2) from the outward line or boundary of all residential zoning districts; 3) from all property lines of any of the following uses: a) Church, charitable institution, school or public playground b) Child day-care center or family day-care home c) Pennsylvania liquor store established, operated and maintained pursuant to the terms of Article III of the Pennsylvania Liquor Code d) Hotel, restaurant or club possessing a retail liquor license issued pursuant to Article IV of the Pennsylvania Liquor Code e) Older adult daily living center licensed by the Department of Aging f) Any “senior center” as defined in Section 3 of the Pennsylvania Senior Center Grant Program Act.
